These Terms of Service (“Terms”) govern your access to and use of the FormShield API and related services (“Services”) provided by FormShield (“we”, “us”, or “our”).
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Services.
1. Account Registration
To use the Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized use of your account.
2. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services for any illegal or unauthorized purpose
- Attempt to circumvent any rate limits or usage restrictions
- Share your API keys with unauthorized third parties
- Use the Services to process content that violates applicable laws
- Resell or redistribute the Services without our written consent
- Interfere with or disrupt the integrity or performance of the Services
3. API Usage and Rate Limits
Your use of the API is subject to rate limits and usage quotas based on your subscription plan. Exceeding these limits may result in throttling, additional charges, or suspension of your account.
4. Fees and Payment
Certain features of the Services require payment. Fees are billed in advance on a monthly basis and are non-refundable except as required by law. We reserve the right to change our fees upon 30 days’ notice.
Overage Charges
If you exceed your plan’s included requests, you will be charged overage fees at the rate specified in your plan details. Overage charges are billed at the end of each billing cycle.
5. Intellectual Property
The Services, including all content, features, and functionality, are owned by FormShield and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any data you submit through the Services.
6. Data Processing
We process data submitted through our API to provide spam detection services. See our Privacy Policy for details on how we handle data. You represent that you have all necessary rights to submit data to our Services.
7. Service Availability
We strive to maintain high availability of our Services but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Services at any time with reasonable notice.
SLA
Paid plans include a Service Level Agreement with uptime guarantees. See your plan details for specific SLA terms.
8. Limitation of Liability
To the maximum extent permitted by law, FormShield shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Our total liability for any claims arising from your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless FormShield and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.
10. Termination
We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website or notifying you via email. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
